AP 14: AFFORDABLE HOUSING: REPORT OF ABUSE.

EXISTING LAW, THE ELDER ABUSE AND DEPENDENT ADULT CIVIL PROTECTION ACT, ESTABLISHES VARIOUS PROCEDURES FOR THE REPORTING, INVESTIGATION, AND PROSECUTION OF ELDER AND DEPENDENT ADULT ABUSE. THESE PROCEDURES REQUIRE CERTAIN PERSONS, CALLED MANDATED REPORTERS, TO REPORT KNOWN OR SUSPECTED INSTANCES OF ELDER OR DEPENDENT ADULT ABUSE, AND CARE CUSTODIANS OF ELDER OR DEPENDENT ADULTS ARE MANDATED REPORTERS.

THIS MEASURE WOULD MEMORIALIZE THE LEGISLATURE AND THE GOVERNOR TO ENACT LEGISLATION THAT WOULD AMEND SECTION 15610.17 OF THE WELFARE AND INSTITUTIONS CODE TO INCLUDE AFFORDABLE HOUSING PROJECTS FOR SENIORS OR PERSONS WITH DISABILITIES AS CARE CUSTODIANS, AND THUS MANDATED REPORTERS OF ABUSE, UNDER THE ELDER ABUSE AND DEPENDENT ADULT CIVIL PROTECTION ACT.

AP 14: RELATING TO ABUSE OF THE ELDERLY OR DISABLED

WHEREAS, SOME AFFORDABLE HOUSING PROJECTS ARE ONLY AVAILABLE TO SENIORS OR PERSONS WITH DISABILITIES; AND

WHEREAS, OWNERS, ADMINISTRATORS, AND EMPLOYEES OF THESE AFFORDABLE HOUSING PROJECTS WHO PROVIDE IN-HOME SERVICES TO SENIORS OR PERSONS WiTH DISABILITIES OR WHO OTHERWISE INTERACT REGULARLY WITH SENIORS OR PERSONS WITH DISABILITIES ARE LIKELY TO BE AWARE IF A RESIDENT OF THAT HOUSING PROJECT IS SUFFERING ABUSE OF ANY KIND; AND

WHEREAS, SENIORS AND PERSONS WITH DISABILITIES WOULD BE BETTER PROTECTED FROM ABUSE, IF THE OWNERS, ADMINISTRATORS, AND EMPLOYEES OF THESE AFFORDABLE HOUSING PROJECTS WERE LEGALLY REQUIRED TO REPORT ANY SIGNS OF ABUSE TO THE APPROPRIATE STATE OR LOCAL AUTHORITIES; AND

WHEREAS, THE ELDER ABUSE AND DEPENDENT ADULT CIVIL PROTECTION ACT ESTABLISHES VARIOUS PROCEDURES FOR THE REPORTING, INVESTIGATION, AND PROSECUTION OF ELDER AND DEPENDENT ADULT ABUSE; AND

WHEREAS, THESE PROCEDURES REQUIRE CERTAIN PERSONS, CALLED MANDATED REPORTERS, TO REPORT KNOWN OR SUSPECTED INSTANCES OF ELDER OR DEPENDENT ADULT ABUSE, AND CARE CUSTODIANS OF ELDER OR DEPENDENT ADULTS ARE MANDATED REPORTERS; NOW, THEREFORE, BE IT

RESOLVED, BY THE SENIOR ASSEMBLY AND THE SENIOR SENATE, JOINTLY, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA AT ITS 2010 REGULAR SESSION, A MAJORITY OF THE MEMBERS VOTING THEREFOR, HEREBY PROPOSES THAT SECTION 15610.17 OF THE WELFARE AND INSTITUTIONS CODE BE AMENDED TO INCLUDE AFFORDABLE HOUSING PROJECTS FOR SENIORS OR PERSONS WITH DISABILITIES AS CARE CUSTODIANS, AND THUS MANDATED REPORTERS OF ABUSE, UNDER THE ELDER ABUSE AND DEPENDENT ADULT CIVIL PROTECTION ACT; AND BE IT FURTHER

RESOLVED, THAT THE SENIOR LEGISLATURE OF THE STATE OF CALIFORNIA RESPECTFULLY MEMORIALIZES THE LEGISLATURE AND THE GOVERNOR OF THE STATE OF CALIFORNIA TO ENACT APPROPRIATE LEGISLATION THAT WOULD ADDRESS THE CONCERNS SET FORTH IN THIS MEASURE; AND BE IT FURTHER

RESOLVED, THAT A COPY OF THIS MEASURE BE TRANSMITTED TO THE SPEAKER OF THE ASSEMBLY, THE PRESIDENT PRO TEMPORE OF THE SENATE, AND THE GOVERNOR OF THE STATE OF CALIFORNIA.
